Влюбленные россияне получили шанс попасть к своим половинкам в Европу

Облегчение въезда для неженатых пар лоббируют Еврокомиссия и общественность

Участники профессионального сообщества «Трэвел Президиум» 17 августа обратили внимание на набирающее популярность онлайн-движение Love is not tourism («Любовь – это не туризм»), которое лоббирует перед властями разных стран снятие ограничений на перемещение в период пандемии COVID-19 для официально не зарегистрированных пар.

Этот вопрос напрямую касается и многих россиян, которые имеют партнеров в зарубежных государствах, в том числе в ЕС, но разделены с ними на протяжении уже нескольких месяцев. Более того, для тех, у кого есть вторая половинка в большинстве стран Шенгенского соглашения, неясны даже перспективы воссоединения, поскольку Евросоюз не называет сроков допуска россиян на свою территорию и точно не собирается делать этого как минимум до сентября.

Правда, сама Еврокомиссия уже в течение двух месяцев призывает членов Евросоюза без промедления разрешить неженатым партнерам граждан и резидентов въехать для воссоединения на территорию Европы. И к настоящему моменту рекомендации чиновников в Брюсселе и просьбы общественности были услышаны многими европейскими странами.

Сейчас разделенные пары имеют шанс встретиться уже в 10 государствах ЕС и Шенгенской зоны. Последним из принявших положительное решение стала 11 августа Франция, а еще ранее это сделали Германия, Дания, Норвегия, Нидерланды, Чехия, Исландия, Финляндия, Австрия и Швейцария.

Однако для того чтобы получить разрешение на въезд, партнерам нужно предоставить солидный пакет документов, доказывающий серьезность и длительность отношений. Это могут быть совместные счета, прошлая переписка, подтверждение совместных путешествий и даже общие фотографии. Но судя по многочисленным счастливым постам в социальных сетях, сделать это вполне реально. Успешным кейсом поделилась и одна из участниц «Трэвел Президиум», рассказав, что у ее знакомых дочь успешно улетела недавно в Швейцарию к своему парню.

«Любовь – это не туризм. Это не про летние каникулы, это про психическое здоровье и будущее людей по всему миру», – заявляют инициаторы движения и призывают снять бюрократические препоны для долговременных, но не зарегистрированных партнеров при соблюдении мер эпидемиологической безопасности: сдачи тестов на коронавирус и строгой 14-дневной изоляции. Принять участие в инициативе можно, используя хештэги #LoveIsNotTourism и #LoveIsEssential в социальных сетях.

Неудивительно, что подобная инициатива удостоилась лестной оценки публики. «Эта группа – просто молодцы! Они пробили новые правила, вот что значит гражданское общество! Количество разлученных влюбленных пар велико! Люди разных стран выкладывают свои истории любви и встречи после долгой разлуки, и это очень трогательно», – подчеркивают в «Трэвел Президиум».

Love Is Not Tourism is a global grassroots movement dedicated to reuniting binational couples and families who have been forcibly separated by travel bans and border closures during the COVID-19 pandemic.

We understand that the closure of international borders in the wake of the COVID-19 pandemic was — and may still be — sensible and even necessary. It is obvious that we must limit tourism to protect ourselves and others.

But love is not tourism. This is not about taking a holiday; it is about family reunification and the future of thousands of couples and families all around the world.

We, as international partners and families, urge governments of all states to implement humanitarian exemptions. Allow the unbureau­cratic and safe reunion of partners in binational relationships as well as excluded family members.

We are willing to submit to appropriate safety regulations: self-paid test upon arrival and quarantine until a negative result is received or a 14 day strict quarantine, as long as unmarried couples, fianceГ©s, and families can visit their most important loved ones, as is possible in Denmark, Norway, the Netherlands and other countries below.

Contact your country’s leader, your ministry of home affairs, or whatever you can find to make yourselves heard. Even politicians are humans. Let them know you are suffering and make them aware of how many international couples actually exist!

EU European Union

AT Austria

The situation in Austria has been clarified. On this ministry website (in the 4th section) they clearly state:

Als LebenspartnerInnen zählen für uns alle Menschen, die sich in einer fixen Beziehung befinden, unabhängig davon, ob sie den gleichen Wohnsitz teilen oder wie lange die Beziehung bereits dauert.

So they define life partners as all persons who are in a fixed relationship, regardless of whether they live together or how long the relationship has existed. And they are exempted from the entry restrictions. We still hear reports of airlines not being properly informed about this, so be careful and call your airline when in doubt.

AU Australia

Australia has very strict measures that put an inhumane arrival cap and total exit ban on residents, that is rumoured to remain in place until mid 2021. You can find a dedicated Google document here. Visit the Australia Compassion Thread in the forums to discuss possible solutions with others.

BA Brazil

According to the Forum Thread about Brazil, international travel restrictions in Brazil have been fully lifted. This might not be an opening in regard to #LoveIsNotTourism, but open is open.

BE Belgium

According to the Belgian Immigration Office, partners can get a short visit (90 days) in Belgium if they «prove a relationship of at least one year, during which they have physically seen each other physically at least twice, for at least 20 days.» IBZ also states that «If a visit has had to be cancelled due to travel restrictions (Covid-19), evidence of the forced cancellation of that visit may be taken into consideration during the planned new visit.» You might be able to get a travel certificate before travelling, such as the one offered by the Belgian consulates in the United States, by contacting your local Belgian consulate.

Our partner group Advocacy for Family Reunification at the Canadian Border has announced success in regards to reuniting couples. To summarize, requirements for entry involve a vaild ETA/VISA and an affidavit describing an at least 1-year relationship. A lawyer/notary will have to assess the relationship and certify the affidavit. Essentially, your Canadian lawyer/notary will do the work for the CBSA so there should not be any CBSA discretion/abuse. We also know that there are compassionate exemptions, and the definition of family now includes grandparents/grandchildren, siblings, etc. There is also an exemption for international students now.For details and further questions, you can reach out to them via their Facebook Page, their Facebook Group or on Twitter or Instagram.

There is also an organized group on Facebook that is fighting for spousal visa applicants. Here’s what they say:

We advocate for the accelerated reunification of families with ongoing spousal sponsorship applications, by the creation of a “Special Temporary Resident Visa” for the time that application is processed. IRCC’s target is to process most applications within twelve months and the pandemic has made matters even worse. The tourist visas are almost always refused. As a result couple are kept apart for several months’ sometimes extending to several years.

CH Switzerland

From 3 August, anyone with a partner in Switzerland will be able to enter the country if they can provide proof of the relationship. You can read more about this change in the official press release. Please also be aware of Switzerland’s quarantine regulations.

Czechia has announced on their website that they are allowing partners to enter under certain circumstances. Here is an excerpt from the announcement, translated by our Discord Community:

“These are, for example, Czech-American couples. From next week, Czechs will be able to invite their partners from abroad, from countries outside the EU, to the Czech Republic to see each other after a few months. This will require a solemn declaration confirming the long-term relationship and that they assume certain obligations similar to married couples. The partners will be able to prove the relationship, for example, with a joint lease agreement, a joint bank account or a birth certificate of common children.” explained Foreign Minister Tomáš Petříček one of the key passages of the new Protective Measure of the Ministry of Health.

We have new information that these rules only apply to people from visa free countries. This means only partners who did not need a visa to enter Czechia before can benefit from the change. You can find more information and discuss this issue in the Czechia Forum Post.

From 10 August 2020 the Bundesministerium des Innern, fГјr Bau und Heimat allows the unmarried partners from third countries who are not on the «Positive List» to visit their partner living in Germany (German, EU citizen or third-country national with an existing residence permit in Germany).

According to the FAQ of the BMI, it must be a long term relationship, duly attested by:

• an invitation from the person resident in Germany together with a copy of the inviting person’s identity papers,
• a relationship declaration form signed by both partners on the relationship with the contact details of both partners, and
• other evidence of previous personal meetings in an appropriate form, in particular by means of passport stamps or travel documents/flight tickets or a common residence abroad; alternatively, supplementary evidence by means of photographs, social media, letter/email correspondence, etc.

On 17 Nov 2020, the FAQ has been updated, stating that it is irrelevant wether previous meetings have been in Germany or another state. This enables all couples to reunite in Germany, as long as they can prove any previous meetings in person.

Update 03 Dec 2020: The Bundespolizei has added a PDF relationship declaration form in German, English and French. The original document has to be signed by both partners.

Update 09 Dec 2020: Individuals entering Germany to visit their partners are exempted from Quarantine. In most cases a negative test taken after or up to 48 hours prior to arrival is required to qualify for the exemption. The exact regulations are stipulated by the individual states

Update 08 Apr 2021: Since the Netherlands have been labelled as a «State with high risk», you now need to quarantine 10 days after arrival (in NRW you can break after 5 days of quarantine with a negative test). You also need a negative PCR-test or an official reviewed rapid test to enter the country. (Source)

Правительству России пора обратить внимание на движение Love is not Tourism

В эпоху пандемии в мире продолжает набирать силу движение Love is not Tourism («Любовь — это не туризм»), добивающееся снятия ограничений на перемещение в период карантина для официально не зарегистрированных пар. Дело в том, что для людей из разных стран, состоящих в официальном браке, Россия и ряд других стран после нескольких первых месяцев пандемии все же разрешили воссоединиться, несмотря на остающиеся ограничения на перелеты. Но этот никак не коснулось пар, чей союз не формализован. Слоган движения – BINATIONAL COUPLES, STAND UP FOR YOUR LOVE! («Интернациональные пары, поднимайтесь на борьбу за вашу любовь!»).

Тем не менее, огромное число влюбленных и давно состоящих в гражданском браке людей по всему миру оказались отрезанными друг от друга: начиная с февраля-марта нынешнего года они находятся по разные стороны границ. Вопрос особенно остро касается молодежи, в том числе женихов и невест, которые планировали оформить свои отношения. Но немало среди разделённых пар и людей в возрасте. 5-6 месяцев разлуки — это для многих критичный срок.

К тому же, в современном мире все больше гражданских, не зарегистрированных официально браков – даже при длительном совместном проживании и наличии общих детей.

Пандемия стала огромным стрессом в их жизни, и большинство интернациональных пар резко протестует против создания преград для их воссоединения.

В связи с этим с июня 2020 года в мире ширится движение Love is not Tourism, уже своим названием говорящее о том, что ограничивать обычный туризм в мире в связи с остающейся опасностью распространения коронавируса пока, возможно, и есть основания, но разбивать сложившиеся пары и ломать их жизнь из-за этого – недопустимо. Тем более, что в разных странах сегодня сложился невероятный разнобой в условиях этих ограничений: нет единого подхода. Евросоюз, в частности, не может даже предположительно сообщить сроки, когда россияне смогут свободно въезжать на его территорию.

Влюбленные пары требуют приравнять их права к правам состоящих в официальном браке. Ведь пока даже в случае болезни они не имеют возможности навещать друг друга и ухаживать друг за другом. Жители разных стран на сайте движения массово подписывают петиции, адресуя их правительствам своих стран с призывом открыть границы для воссоединения. Свою подпись под петициями можно оставить на сайте движения (#loveisnottourism).

Правительства отдельных стран наконец стали прислушиваться к тысячам искусственно разделенных сердец. Первой на эти призывы откликнулась Еврокомиссия, которая два месяца назад призвала страны Шенгена разрешить неженатым парам воссоединиться на территории Европы. Этому совету на сегодняшний день одна за другой последовало около десятка стран: Германия, Дания, Норвегия, Нидерланды, Чехия, Исландия, Финляндия, Франция, Австрия, Швейцария, Бельгия. Последней к ним присоединилась Италия, которая, правда, ограничила возможность въезда только месяцем — подать документы на такую визу или получить разрешение на въезд при уже имеющейся шенгенской визе можно лишь до 7 октября.

Правда, и доказать наличие реальных отношений не так-то просто: партнерам необходимо представить в консульство интересующей страны документальные доказательства длительности и серьезности отношений. Это могут быть общие счета и договора аренды жилья, подтверждение совместных путешествий, совместные фотографии, личная переписка. Для оформления въездной визы чаще всего требуется приглашение от партнера-жителя Евросоюза и совместно подписанная декларация, подтверждающая отношения пары.

Для каждой страны есть свои списки необходимых документов, но практически везде нужно подтвердить тот факт, что пара встречалась до закрытия границ, как минимум, полгода. Большинство государств при въезде требуют также отрицательный тест на COVID.

Россиянам и россиянкам, которых очень много среди пострадавших, кажется странным, что правительство России, в отличие от западных стран, до сих пор не отреагировало на призывы движения. Распоряжение премьер-министра Михаила Мишустина, давшего разрешение на выезд россиян и въезд иностранцев в Россию, подписанное в августе, касается только официальных браков и близких родственников.

Россияне также массово требуют от своего правительства обратить, наконец, внимание и на гражданские браки, и на влюбленные сложившиеся пары.

Между тем, на страничках движения в интернете каждый день появляются радостные сообщения от пар, воссоединившихся в третьей стране (например, в Турции или в Черногории), куда въезд разрешен жителям максимального числа стран. «Поздравьте нас, мы, наконец, встретились!», — пишут они, демонстрируя счастливый момент воссоединения совместными фотографиями. Наметилась и совершенно новая тенденция: те, кто ранее не придавал значения штампу в паспорте, стараются сегодня, встретившись, спешно зарегистрировать отношения, опасаясь вновь попасть в жернова пандемии.
